System runs on Constitution, not military courts: CJ of Pakistan

SLAMABAD: Chief Justice Iftikhar Muhammad Chaudhry, hearing the Zulfikar Ali Bhutto reference case on Wednesday, said that the system does not run according to military courts, it runs on the Constitution.
He added that till the judiciary follows the Constitution, the Constitution will remain supreme in the country. He added that the court had also terminated military court’s law in the Liaquat Hussain case in the past.
Sindh’s advocate general complained that the framer of the Constitution, that is former Prime Minister Zulfikar Ali Bhutto, was hanged and the case requires that justice be done. He said that the court had expanded its jurisdiction in the Nawaz Sharif case and heard the case even after years; however, the chief justice replied that the case was not related to Article 186 of the Constitution.
Justice Sarmad Jalal Osmani also responded to advocate general’s statement by saying that the law stands the same for everyone.
The chief justice remarked that the case should be assisted on lawful and constitutional grounds, rather than on emotional ones, and whatever decision is taken by the court, it will set a precedent in the future.
